These Terms and Conditions govern any reservation booked through The Suite Pass ("TSP"). By accepting the quote and paying the deposit, you become bound by them pursuant to Article 89 et seq. of the Mexican Commerce Code. Please resolve any question before payment by writing to hello@thesuitepass.com.

Estos Términos y Condiciones rigen cualquier reservación contratada a través de The Suite Pass ("TSP"). Al aceptar la cotización y pagar el depósito, quedas obligado por ellos conforme al artículo 89 y siguientes del Código de Comercio mexicano. Resuelve cualquier duda antes del pago escribiendo a hello@thesuitepass.com.

1. Scope of service

1. Alcance del servicio

TSP places stays at resorts operated by Tafer Hotels & Resorts in Mexico, using inventory from verified members of the Tafer Residence Club. TSP is neither the resort nor a travel agency; it manages the reservation from your request through check-in. The stay, service and amenities are the resort’s responsibility from the moment you check in.

TSP coloca estancias en resorts operados por Tafer Hotels & Resorts en México, con inventario de socios verificados del Tafer Residence Club. TSP no es el resort ni una agencia de viajes; gestiona la reservación desde tu solicitud hasta el check-in. La estancia, el servicio y las amenidades quedan a cargo del resort desde el momento del registro.

A quote is not a confirmed reservation. A booking is confirmed only when (i) TSP verifies availability with the resort, (ii) you pay the deposit, and (iii) TSP sends you the confirmation with the reservation reference in your name.

Ninguna cotización constituye reserva confirmada. La reserva se confirma solo cuando (i) TSP verifica disponibilidad con el resort, (ii) pagas el depósito y (iii) TSP te entrega la confirmación con el número de reserva a tu nombre.

2. Price and taxes

Prices are quoted and paid exclusively in U.S. dollars (USD). The quote itemizes lodging, VAT and the applicable Lodging Tax; the total shown is what you pay. Taxes by destination:

Los precios se cotizan y pagan exclusivamente en dólares estadounidenses (USD). La cotización desglosa alojamiento, IVA e Impuesto Sobre Hospedaje aplicables; el total mostrado es lo que pagas. Impuestos por destino:

• Cancún (Quintana Roo): VAT 16%, Lodging Tax 3%, and a state environmental tax of USD $2 per adult per day.
• Cancún (Quintana Roo): IVA 16%, Impuesto Sobre Hospedaje 3% e impuesto ambiental estatal de USD $2 por adulto por día.
• Puerto Vallarta (Jalisco): VAT 16% and Lodging Tax 3%.
• Puerto Vallarta (Jalisco): IVA 16% e Impuesto Sobre Hospedaje 3%.
• Los Cabos (Baja California Sur): VAT 16% and Lodging Tax 4%.
• Los Cabos (Baja California Sur): IVA 16% e Impuesto Sobre Hospedaje 4%.

Local authorities may enact minor local contributions without prior notice; if so, the resort charges them at check-in. The All-Inclusive plan is optional and not included in the price — it is contracted directly at the resort’s reception at the current daily rate, three-day minimum. Consumption and additional charges during the stay are paid directly to the resort.

Las autoridades locales pueden establecer contribuciones menores sin previo aviso; de ocurrir, el resort las cobra al check-in. El plan Todo Incluido es opcional y no está incluido en el precio — se contrata directamente en la recepción del resort a la tarifa vigente, con mínimo de tres días. Consumos y cargos adicionales durante la estancia se pagan directamente al resort.

3. Deposit, balance and payment

The reservation is confirmed upon payment of the deposit. The balance is due before arrival, by season:

• Standard season: 25% deposit at booking · 75% balance 45 days before check-in.
• Temporada estándar: 25% de depósito al reservar · 75% de saldo 45 días antes del check-in.
• Holiday season: 50% deposit at booking · 50% balance 45 days before check-in.
• Temporada Holiday: 50% de depósito al reservar · 50% de saldo 45 días antes del check-in.
• Less than 45 days out: full payment at booking.
• A menos de 45 días: pago completo al reservar.

Holiday season includes Christmas, New Year, Easter, Thanksgiving and Spring Break weeks, per the calendar published with each quote. Payment is made through the means TSP specifies in the quote. Accepting the quote and paying the deposit is a manifestation of intent and electronic signature under Article 89 et seq. of the Mexican Commerce Code.

Se considera temporada Holiday las semanas de Christmas, New Year, Easter, Thanksgiving y Spring Break, según el calendario publicado con cada cotización. El pago se realiza por los medios que TSP indique en la cotización. Aceptar la cotización y pagar el depósito constituye manifestación de voluntad y firma electrónica conforme al artículo 89 y siguientes del Código de Comercio.

4. Cancellations and changes

Please read carefully before paying. Deposits are non-refundable from the moment of payment. TSP retains 25% of eligible deposits to cover administrative charges and resort penalties on inventory already allocated. This mechanism is expressly accepted upon payment.

Lea con atención antes de pagar. Los depósitos son no reembolsables desde el momento del pago. TSP retiene el 25% de los depósitos elegibles para cubrir cargos administrativos y penalizaciones del resort sobre inventario ya asignado. Este mecanismo se acepta expresamente al pagar.

• Standard season: more than 60 days before check-in → 75% of the deposit refunded (25% retained). Between 60 and 30 days → no deposit refund, but TSP will attempt to reallocate the window. Less than 30 days → no refund.
• Temporada estándar: más de 60 días antes del check-in → reembolso del 75% del depósito (25% retenido). Entre 60 y 30 días → sin reembolso del depósito, pero TSP intentará recolocar la ventana. A menos de 30 días → sin reembolso.
• Holiday season: the window extends to 90 days. More than 90 days → 75% refunded (25% retained). Less than 90 days → no refund.
• Temporada Holiday: la ventana se extiende a 90 días. Más de 90 días → reembolso del 75% (25% retenido). Menos de 90 días → sin reembolso.
• Balance: the balance paid at 45 days is refundable only if you cancel before it becomes due.
• Saldo: el saldo pagado a 45 días es reembolsable solo si cancelas antes de que se vuelva exigible.
• No-show: the reservation is deemed consumed and there is no refund.
• No presentación: la reservación se considera consumida y no hay reembolso.
• Name change: free of charge, provided dates are unchanged; the new guest presents official ID at arrival and accepts these Terms.
• Cambio de nombre: sin costo, siempre que las fechas no cambien; el nuevo huésped presenta identificación oficial al llegar y acepta estos Términos.
• Date change: subject to availability; a seasonal price difference and a resort rebooking fee may apply, borne by the guest. Same price or suite is not guaranteed.
• Cambio de fechas: sujeto a disponibilidad; puede aplicar diferencia de precio por temporada y una cuota de reprogramación del resort, a cargo del huésped. No se garantiza igual precio ni misma suite.
• Causes beyond the guest: if the resort cancels or the stay cannot be delivered for reasons not attributable to you, TSP refunds what was paid for lodging. That refund is the limit of TSP’s liability.
• Causas ajenas al huésped: si el resort cancela o la estancia no puede entregarse por razones ajenas a ti, TSP reembolsa lo pagado por el alojamiento. Esa devolución es el límite de la responsabilidad de TSP.

5. Your stay and personal data

5. Tu estancia y datos personales

Check-in is at the resort front desk, available 24/7; present official photo ID and your reservation reference. Reference times are arrival from 4:00 PM and departure by 11:00 AM (final times set by the resort). From check-in onward, the room and service are the resort’s responsibility; TSP does not manage transportation, tours or tourism services.

El check-in es en la recepción del resort, disponible 24/7; presenta identificación oficial con fotografía y tu referencia de reserva. Los horarios de referencia son llegada desde 4:00 PM y salida hasta 11:00 AM (los definitivos los fija el resort). A partir del check-in, la habitación y el servicio quedan a cargo del resort; TSP no gestiona transporte, tours ni servicios turísticos.

You are subject to the resort’s rules (occupancy, minors, dress code, adults-only condition where applicable) and liable for any damage caused, per those policies. Your personal data is used solely to manage the reservation and is processed under Mexico’s Federal Law on Protection of Personal Data (LFPDPPP). See our privacy notice.

Te sujetas a las reglas del resort (ocupación, menores, código de vestimenta, condición de solo adultos donde aplique) y respondes por los daños que causes, conforme a esas políticas. Tus datos personales se usan únicamente para gestionar la reservación y se tratan conforme a la Ley Federal de Protección de Datos Personales (LFPDPPP). Consulta nuestro aviso de privacidad.

6. Liability

6. Responsabilidad

TSP is responsible for managing the reservation. Its liability, if any, is capped at the amount paid for lodging on the affected reservation; TSP is not liable for indirect damages, related travel expenses or loss of enjoyment, nor for acts attributable to the resort (service quality, amenities, incidents, or the security of guests or their belongings) — recourse for those lies directly with the resort. Neither party is liable for force majeure (natural disasters, government acts, health restrictions, border or airport closures); in such cases TSP will attempt to reschedule at no extra cost or refund lodging not consumed, at your election.

TSP responde por la gestión de la reservación. Su responsabilidad, de existir, se limita al monto pagado por el alojamiento de la reserva afectada; TSP no responde por daños indirectos, gastos de viaje conexos ni pérdida de disfrute, ni por hechos imputables al resort (calidad del servicio, amenidades, incidencias, o la seguridad de los huéspedes o sus bienes) — el recurso por esos hechos es directamente con el resort. Ninguna parte responde por caso fortuito o fuerza mayor (desastres naturales, actos de gobierno, restricciones sanitarias, cierres de frontera o aeropuerto); en tales casos TSP intentará reprogramar sin costo adicional o reembolsar el alojamiento no consumido, a tu elección.

7. Governing law and disputes

7. Ley aplicable y controversias

These Terms are governed by Mexican federal law; the parties submit to the jurisdiction of Mexico City. Any dispute is first addressed through good-faith negotiation; if unresolved, it is settled by arbitration under the Rules of the Centro de Arbitraje de México (CAM), seat in Mexico City, in Spanish, before one arbitrator. The prevailing party may recover reasonable costs. These Terms, together with the accepted quote and the privacy notice, constitute the entire agreement regarding the reservation.

Estos Términos se rigen por la legislación federal mexicana; las partes se someten al fuero de la Ciudad de México. Cualquier controversia se resuelve primero de buena fe; si no se resuelve, se somete a arbitraje del Centro de Arbitraje de México (CAM), con sede en la Ciudad de México, en español, ante un árbitro. La parte vencedora podrá recuperar las costas razonables. Estos Términos, junto con la cotización aceptada y el aviso de privacidad, constituyen el acuerdo íntegro respecto de la reservación.

8. Acceptance

8. Aceptación

Acceptance occurs when you (i) review and accept the quote, (ii) check the acceptance box during the payment process, and (iii) pay the deposit or applicable amount — together a manifestation of intent and electronic signature under Article 89 et seq. of the Mexican Commerce Code. TSP keeps the digital record (quote email, acceptance mark, payment receipt) as evidence; request access at hello@thesuitepass.com.

La aceptación ocurre cuando (i) revisas y aceptas la cotización, (ii) marcas la casilla de aceptación en el proceso de pago y (iii) pagas el depósito o el monto correspondiente — en conjunto, manifestación de voluntad y firma electrónica conforme al artículo 89 y siguientes del Código de Comercio. TSP conserva el registro digital (correo de cotización, marca de aceptación y comprobante de pago) como prueba; solicita acceso en hello@thesuitepass.com.
